Terms and Conditions 

 The following T&C's apply unless a speciifc contract has been agreed containing specific agreed changes to these terms and conditions.

 

The relevant consultant / trainer providing the service can only offer guidance not advice about the application of current legislation.

 

We do not offer specific advice regarding the legal actions individuals or organisations should take regarding specific cases.

 

All legal information exchanged throughout the training / consultancy process has the status of guidance only.

 

The commissioning organisation is advised that the legislation relating to equality and human rights is complex and subject to frequent amendments, new interpretation and legal challenges.

 

Whilst all care is taken by representatives and associates of Fair Play Training & Consultancy Services Ltd to remain alert to these changes, the commissioning  organisation is advised to continue to obtain legal advice from the appropriate professional legal services.

 

Any action taken including costs associated with any action the commissioning  organisation may take as a result of guidance offered through the training & consultancy process, is taken at the commissioning organisations own risk and FPT Ltd cannot be held liable for any action or associated costs.

 

Diversity related issues:

 

The commissioning organisation is responsible for ensuring that the trainer / consultant is made aware of any diversity related issues that are relevant to the training or consultancy process.

 

Issues that may influence the choice of training materials, course structure, training methods style or consultancy approach should be communicated to the trainer no less than 14 days prior to the training event.

 

Should disability related issues be raised FPT Ltd will work with the commissioning organisation to make reasonable adjustments to the programme content, delivery style & methods used to minimise any possible disadvantage.

 

In the event of diversity issues arising and in cases when no prior notice has been given by the commissioning organisation FPT Ltd will make every effort to prevent disadvantages from occurring but cannot accept liability if this occurs.

 

Associated Trainers:

 

All Associated trainers are covered by Professional Indemnity & Public Liability insurance. They are independent trainers who have agreed to provide professional training services for and on behalf of FPT Ltd.

 

They cannot be approached by FPT clients to provide training services independent from FPT and are contracted to refuse and report any such approach.

 

They are also prohibited from advertising their services independant of FPT Ltd.

 

Whilst every effort is made by FPT Ltd to ensure that their services are provided to the highest professional standard, in circumstances were this is not the case clients should indicate this at the earliest opportunity and all effort will be made to resolve any issues that may have arisen.

 

Cancellation & Postponement:

 

Should any service understood to represent a confirmed service request (via a contract, letter or email) be cancelled for whatever reason by the commissioning organisation or any person acting with its authority, all fees which relate to that service will be deemed payable in full within 30 days of the service being cancelled.

 

If a confirmed service is postponed by the commissioning organisation or any person acting with its authority, it will be subject to a 50% postponement fee if it is not accompanied with a new date at the time of the postponement.

 

New dates must fall within 60 days of the postponed dates or they will be deemed a cancellation requiring payment in full. 

 

Postponements which are accompanied by new dates to be delivered within 60 days of the postponed dates - no fee is payable.

 

If a service is postponed more than once it will deemed to represent a cancellation requiring payment in full.

 

If a representative of FPT Ltd has to postpone a service (for whatever reason), the postponement will result in a 50% reduction in the agreed fee for any individual training / consultancy service which has to be rearranged.

 

No liability can be accepted for any costs that may be incurred by the commissioning organisation in the event of a postponement (for whatever reason) by a representative of FPT Ltd accept in relation to the agreed reduction of fee.

 

Room Setup & Equipment:

 

Please note that to minimise the risk of health & safety issues arising, trainers / consultants from FPT Ltd will not be responsible for moving, lifting or handling furniture in order for the training room to be set up as requested.

Clients are responsible for ensuring that when a room layout and equipment has been requested it is in place in readiness for the course to be able to proceed on time.

 

Clients are responsible for ensuring that the room size is suitable for the training event to take place – it must be suitable for the intended numbers and activities in circumstances were this is not the case the course may have to be cancelled if no alternative room is available.

 

Delegate Numbers:

 

Once maximum course participant numbers have been agreed these must not be exceeded, a fee equal to £75 will be payable for each additional person attending the course.

 

This will automatically be added to the invoice along with a copy of the register.

 

Because courses are prepared at least 2 weeks in advance of the anticipated delivery date and are prepared taking into account the minimum course participant numbers, clients must confirm the final course participant numbers at least 14 days prior to the course.

 

If numbers fall below the agreed delegate minimum number for it to proceed, the course will automatically be deemed to have been cancelled by the commissioning organisation and the cancerllation fee applies.

 

Equal Opportunities:

 

FPT Ltd agrees to promote the values and principles associated with the promotion of equal opportunities and diversity. It will be the case that FPT trainers will ensure that their own & participants language and behaviour is appropriate at all times.

 

Venue details / maps / registers:

 

The commissioning organisation is responsible for ensuring that details of the venue and hotel (if applicable) together with course registers are forwarded at least 14 days prior to a course taking place.
